La tutela giurisdizionale collettiva nell’ordinamento italiano dopo l’intervento legislativo del 2023

The paper analyses the provisions of the implementation Decree n. 28/2023 of the EU Directive n. 1828/2020 related to representative actions for the protection of the collective interests of the consumers. The provisions included in the Italian decree seem to be poorly manifactured, as they reproduce norms of the Directive without properly coordinating them with the pre-existent, recent set of rules (Law. no. 31/2019). Given the italian procedural framework, a clarifying judicial interpretation and a new reform are considered opportune.
