This contribution offers a commentary on a judgment of the Court of Justice in which it was ruled that Article 7(1) of Directive 2003/88/EC and Article 31(2) of the Charter of Fundamental Rights of the European Union must be interpreted as not precluding national legislation or practice that does not allow the carry-over of paid annual leave days. Article 31(2) of the Charter of Fundamental Rights of the European Union must be interpreted as not precluding national legislation or practice that does not allow the carry-over of days of paid annual leave granted to a worker who is placed in quarantine, even if not ill, for a period coinciding with the period of compulsory isolation ordered by a public authority because of that worker's contact with a person infected with SARS-CoV-2.
Nel presente contributo è commentata una sentenza della corte di giustizia, in cui è statuito che l’art. 7, § 1, della direttiva 2003/88/CE e l’art. 31, § 2, della Carta dei diritti fondamentali dell’Unione europea devono essere interpretati nel senso che non ostano a una normativa, o a una prassi nazionale, che non consenta il riporto dei giorni di ferie annuali retribuite concessi ad un lavoratore costretto alla quarantena, ancorché non malato, per un periodo coincidente con quello dell’isolamento obbligatorio, disposto da un’autorità pubblica, a causa del contatto di tale lavoratore con una persona infetta da SARS-CoV-2.
