Sull'unitarietà del nesso causale (Studio critico sulla teoria del doppio nesso)

The essay addresses the question of the duplicity of causation in the two types of civil liability. The study challenges the prevailing opinion, in doctrine and case law, according to which it is possible to identify two links: one of material causation, which links the conduct to the event of damage (or “danno-evento”), and one of juridical causation, which links the event of damage to the other injurious consequences (or “danno-conseguenza”). The thesis supported in the essay leans towards the unity of the causation and the plurality of its functions.

Il saggio affronta la questione della duplicità dei nessi di causalità nelle due specie della responsabilità civile. Lo studio contesta l’opinione prevalente, in dottrina e in giurisprudenza, secondo cui è possibile individuare due nessi: uno di causalità materiale, che lega la condotta all’evento di danno (o « danno-evento »), e uno di causalità giuridica, che lega l’evento di danno alle altre conseguenze dannose (o « danno-conseguenza »). La tesi sostenuta nel saggio propende per l’unitarietà del nesso causale e per la pluralità delle sue funzioni.
