“Le radici profonde non gelano”: le manifestazioni fasciste al vaglio delle Sezioni Unite: tra storia e diritto

The paper draws on the long-awaited judicial intervention on the crime punishing the customary manifestations of the dissolved fascist party to critically analyze the argumentative rhetoric of the concrete danger of reconstitution also in light of a much-needed interdisciplinary comparison with the historiographical knowledge on the subject and proposes to identify the protected interest in the antifascist memory as the basis of the republican constitutional identity.
