The paper aims to tackle the delicate question of the politicisation of human rights. Through an analysis led by Professor De Sena of the recent work of international courts, two paths emerge: one moving towards politicisation and the other towards vitality. The question of politicisation then assumes a double meaning, and a subtle – yet present – line between manipulation and strategy is finally drawn. Climate litigation offers an example of the latter by providing a path towards new vitality, albeit still limited, for human rights.
