The contribution proposes a reading of the 2023 public contracts Code from the criminal lawyer’s perspective. This is, so to speak, a «lateral» point of view, since the reformed procurement regulations do not contain elements of obvious criminal relevance. Nonetheless, the new award criteria, the liberal- ization of subcontracting and the introduction of the principle of mandatory nature of the grounds for exclusion offer the opportunity to reflect on the anti-corruption and anti-mafia discipline and the fight against the exploitation of workers.
