This article examines two judgments of the Court of Palermo, issued at the end of two proceedings for the repression of anti-union behavior brought by trade unions representing riders. As far as is known, these are the first rulings on the obligation of the employer to inform the trade unions of the nature and operation of automated systems. On this point, the time gap between the two decisions provides an opportunity to reflect on the changes introduced by Article 26 of Legislative Decree No. 48 of 4 May 2023. The reasons for the recognition of RSAs and RLSs are also of particular interest, as they reveal the limits of the current discipline and the need for an evolutionary interpretation of the legal provisions for the protection of workers in the "gig economy". Finally, following the hermeneutic path of the second judge, the compatibility between the remedy of "astreinte" and the procedure of repression of anti-union behavior is examined.
Il presente contributo esamina due decreti del Tribunale di Palermo, adottati a conclusione di altrettanti procedimenti per la repressione della condotta antisindacale (art. 28 St. lav.), promossi da organizzazioni sindacali rappresentative dei ciclofattorini. Si tratta, per quanto consta, delle prime pronunce riguardanti l’obbligo del committente di informare i sindacati sulla natura ed il funzionamento dei sistemi automatizzati. Sul punto, la distanza temporale tra le due decisioni offre l’occasione per riflettere sulle novità introdotte dall’art. 26 del d.l. 4 maggio 2023, n. 48. Anche le motivazioni in materia di riconoscimento di RSA e RLS rivestono particolare interesse, poiché rivelano i limiti della disciplina vigente e la necessità di un’interpretazione evolutiva delle disposizioni statutarie, a tutela dei lavoratori della “gig economy”. Infine, seguendo l’itinerario ermeneutico del secondo giudice, verrà vagliata la compatibilità tra il rimedio dell’astreinte e il procedimento per la repressione della condotta antisindacale.
