The contribution explores the question of the relationships between judicial activity and freedom of information, taking into consideration the distinction between judicial information and mediatic criminal proceeding, which, being different realities, require a different balancing of the constitutional values at stake. Legislative discipline, impacting on the institutional communication, has proven inadequate to stem the deteriorating aspects of the mediatic representation of justice; instead, an overall rethinking of the relevant issues would be appropriate, with a view to more organic regulatory interventions.
