The purpose of this paper is to investigate the issue of hereditary succession concerning the rights of control, recognised by the GDPR, over the digital personal data of the deceased, by comparing different regulatory and applicative models developed in European national legal systems and, in particular, in Italy, France and Spain. The contribution deals as much on the configurability of a case of legitimate succession as on the contents and forms of expression of private autonomy. Finally, the essay highlights the elements of renewal that the model of digital inheritance may bring to succession law as a system.

Abstract
