Thanks to neuroimaging techniques, we can see the brain in action and we are led to attribute to its mechanisms what a long philosophical tradition attributed instead to freedom. However, neurosciences can “prove” the culpability or incapacity of a defendant only on the basis of the philosophical, not scientific, thesis “we are our brain”. Are we bodies driven by brain devices shaped by the environment or people capable of self-determination?
