L’INSERIMENTO DELLO SPORT IN COSTITUZIONE: PRIME OSSERVAZIONI

Starting with an excursus on the constitutional bills presented in the last 25 years to introduce the subject of sport into the Constitution, the work focuses on the current text of the art. 33 of the Constitution, as innovated by Constitutional Law 1/2023, and on the examination of the reasons that led to the positive conclusion of the reform process. The purpose of the paper is to highlight how the recognition of the social value of sport, established by the Constitution, does not only have programmatic value but contains a concrete recognition of an individual legal situation, such as "citizenships’ sport", which will only find protection following the concrete actions that will be adopted at a governmental and legislative level

Premettendo un excursus sui disegni di legge costituzionali presentati negli ultimi 25 anni al fine di introdurre la materia dello sport in Costituzione, il lavoro si concentra sull’attuale testo dell’art. 33 della Carta costituzionale, come innovato dalla L. Cost. 1/2023, e sulla disamina delle motivazioni che hanno portato alla positiva conclusione dell’iter di riforma. In particolare, si vuole evidenziare come il riconoscimento del valore sociale dello sport, attualmente sancito dalla Costituzione, non abbia solo valore programmatico ma contenga in nuce il riconoscimento concreto di una situazione giuridica soggettiva individualmente riconosciuta, quale lo “sport di cittadinanza”, che potrà trovare tutela solo in esito alle concrete azioni che verranno adottate a livello governativo e legislativo.
