Lost in translation: le intercettazioni per instradamento di chat crittografate

The Supreme court confirmed that, with regard to the wiretapping means of the routing technique, the acquisition of pin-to-pin chats exchanged on BlackBerry systems does not require an international rogatory when the communications took place in Italy. The jurisprudence of the Supreme court thus circumvents the prohibition of non- use resulting from the failure to activate the rogatorial procedure guaranteed by Article 727 of the Code of Criminal Procedure to the full advantage of investigative purposes and to the complete prejudice of the system’s guarantees.

La Corte di cassazione ha confermato che, in tema di intercettazioni telefoniche eseguite mediante la tecnica dell’instradamento, l’acquisizione delle chat pin-to-pin scambiate su BlackBerry non richiede la rogatoria internazionale quando le comunicazioni sono avvenute in Italia. La giurisprudenza di legittimità elude così il divieto di inutilizzabilità derivante dal mancato ricorso alla procedura prevista dall’art. 727 c.p.p. a totale vantaggio delle finalità investigative e a completo pregiudizio dei presidi di garanzia del sistema.
