Il nuovo rito delle relazioni familiari, il prisma dell’effettività e i formanti del diritto di famiglia: verso un ordine possibile

The new preceduarl rules on family relations, introduced by the Cartabia reform, makes it possible to trace in the effectiveness of remedies an ideal red thread that, linking up with the more general debate on the formants of family law, lets the lines of the possible order emerge that can be referred to in a pluralist society: an order built on the centrality of the person, on the primacy of the interests that pertain to him, even if to be balanced with values of solidarity

Il nuovo rito delle relazioni familiari, introdotto dalla roforma Cartabia, consente di rintracciare nella effettività delle tutele un ideale filo rosso che, riannodandosi al dibattito più generale sui formanti del diritto di famiglia, lascia emergere le linee dell'ordine possibile che al quelle stesse relazioni è dato riferire in una società pluralista: l'ordine costuito sulla centralità della persona, sul primato degli interessi che le pertengono, seppure da bilanciare con valori di solidarietà
