Taking into account some reflections contained in an unpublished letter written by Otto Lenel (1849-1935) to Salvatore Riccobono (1864-1958) in December 1926, the texts of D. 44.7.33 (Paul. 3 decr.) and D. 2.11.10.2 (Paul. 1 ad Plaut.) are re-examined and the possibility that in the formular procedure a penal action could be passively transmitted to the heirs of the defendant by including in the formula a fictio of the litis contestatio is critically discussed.

Abstract
