The work analyzes the figure of the disabled in modern society with reference to sport. The author focuses on the relation between protection tools of private law and exercise of constitutional freedoms, considering the recent reform of art. 33 of the Constitution, of principles proclaimed by supranational legislation, and of sports legal system rules. A particular attention il paid to risky sports activities by people with mental disabilities.
