La responsabilità del produttore farmaceutico per prodotto difettoso: verso un sistema di strict liability?

The contribution reflects on the recent arrival of legitimacy jurisprudence according to which the liability of the drug manufacturer is not excluded from the proof of having provided - through the package leaflet (so-called "leaflet") - information that takes the form of a mere generic warning about the non-safety of the product, since suitable information is required to allow the consumer to carry out a correct assessment of the risks and benefits in this regard and to adopt all the necessary precautions aimed at avoiding the onset of damage, which is such as to found a voluntary and conscious exposure to risk (with possible contributory negligence pursuant to article 1227 of the civil code, in the event of relative underestimation or abuse of the drug).

Il contributo riflette sul recente approdo della giurisprudenza di legittimità secondo cui la responsabilità del produttore di farmaci non è esclusa dalla prova di aver fornito — tramite il foglietto illustrativo (c.d. « bugiardino ») — un’informazione che si sostanzi in una mera avvertenza generica circa la non sicurezza del prodotto, essendo necessaria un’informazione idonea a consentire al consumatore di effettuare una corretta valutazione dei rischi e dei benefici al riguardo e di adottare tutte le necessarie precauzioni volte ad evitare l’insorgenza del danno, che sia tale da fondare una volontaria e consapevole esposizione al rischio (con eventuale suo concorso di colpa ex art. 1227 c.c., in caso di relativa sottovalutazione o di abuso del farmaco).
