This contribution is based on the analysis of two recent precautionary orders by the Court of Rome concerning the request for the reactivation of CasaPound and Forza Nuova profiles, following the sanctioning measures adopted by Facebook. Although the judicial disputes under analysis share the same petitum, the outcome is antithetical. While in the case involving CasaPound, the precautionary judge declared the illegitimacy of the social network’s intervention, since it was contrary to freedom of expression and the pluralist principle recognized by our legal system, in the case involving Forza Nuova, the Court of Rome rejected the appeal and confirmed the measures adopted. Both ordinances share the same profile: the overcoming of a strictly contractual assessment of the relationship that is the subject of the disputes examined, due to the evolution of the role that Facebook has assumed in our time as a tool available to political parties.

Il presente contributo muove dall’analisi di due recenti ordinanze cautelari del Tribunale di Roma inerenti alla richiesta di riattivazione dei profili di CasaPound e Forza Nuova, in seguito alle misure sanzionatorie adottate da Facebook. Nonostante le controversie giudiziarie oggetto di analisi condividano lo stesso petitum, l’esito è antitetico. Mentre nel giudizio che ha coinvolto CasaPound il giudice cautelare ha dichiarato l’illegittimità dell’intervento del social network, in quanto contrario alla libertà di espressione e al principio pluralista riconosciuto dal nostro ordinamento, nella vicenda che ha interessato Forza Nuova il Tribunale di Roma ha respinto il ricorso ex art. 700 c.p.c. e confermato le misure adottate. Entrambe le ordinanze condividono un medesimo profilo: il superamento di una valutazione strettamente contrattuale del rapporto oggetto delle controversie esaminate, in ragione dell’evoluzione del ruolo che nel nostro tempo Facebook ha assunto come strumento a disposizione dei partiti politici “per concorrere a determinare la politica nazionale”.
