Responsabilità civile e pandemia

The essay proposes a reflection on the use of civil liability to deal with the damage from covid 19, questioning the role that, in the context of mass damage, can in fact play the institute, its functions and its limits. Starting from the analysis of the criteria that govern the formulation of the judgment of responsibility, the author dwells, in particular, on the clause of injustice, as a central junction for the affirmation of civil liability. The parameter of injustice is therefore placed in the perspective of the reasonable balance between fundamental rights which, in the name of a supreme principle of dignity, induces the Courts to seek a reasonable point of balance, which cuts off upstream any attempt at tyranny. After analyzing the types of damage produced by the pandemic, a civil liability function is envisaged that can overcome the screening of injustice through the use of indemnity techniques. Thus, on the basis of a principle of solidarity, a distinction between compensation and compensation is recovered which, as is well known, is difficult to find confirmation in positive law.

Il saggio propone una riflessione sull’uso della responsabilità civile per fronteggiare i danni da covid 19, interrogandosi sul ruolo che, nel contesto di danni di massa, può di fatto rivestire l’istituto, le sue funzioni ed i suoi limiti. Muovendo dall’analisi dei criteri che presiedono alla formulazione del giudizio di responsabilità, l’autore si sofferma, in particolare, sulla clausola dell’ingiustizia, quale snodo centrale per l’affermazione di una responsabilità civile. Il parametro dell’ingiustizia, viene collocato quindi nella prospettiva del bilanciamento ragionevole tra diritti fondamentali che, in nome di un principio supremo di dignità, induce le Corti alla ricerca di un ragionevole punto di equilibrio, che recida a monte ogni tentativo di tirannia. Analizzate le fattispecie di danno prodotte dalla pandemia, si prospetta una funzione della responsabilità civile in grado di superare il vaglio dell’ingiustizia attraverso l’uso di tecniche indennitarie. Si recupera, così, in ragione di un principio di solidarietà, un distinguo tra risarcimento ed indennizzo che, come è noto, stenta a trovare conferme nel diritto positivo.
