Italian Law Decree No. 11 of 2009 (converted into Law No. 38 of 2009), by introducing into the Criminal Code the crime of stalking (Article 612-bis), at the same time amended Article 576(1) of the Criminal Code, by including among the aggravating circumstances of intentional homicide the fact that the offender committed stalking against the same victim. It should also be considered that this amendment of Article 576 of the Criminal Code affects also Article 585 of the Criminal Code, which provides that in “the cases provided for in Articles 582, 583, 583-bis, 583-quinquies and 584, the penalty shall be increased from a third to a half, if any of the aggravating circum- stances provided for in Article 576 is present”. In this judgement, the Italian Supreme Court, Criminal Joint Session, stated that murder aggravated by the previous commission of stalking constitutes a complex offence, which, however, would not occur in the parallel hypothesis of bodily harm. The Author in general agrees with the judgement, but not with this last assertion, considering instead that this last hypothesis is consistently a complex offense as well. It is true that the legislator, having left unchanged the text of the aggravating circumstance of Article 585 of the Criminal Code, provides for a penalty that is paradoxically lower than the one now established by Article 612-bis of the Criminal Code for stalking; but it is up to the legislator or the Constitutional Court to resolve this evident normative unreasonableness.

Come si ricorderà, il D.L. n. 11 del 2009 (conv. in L. n. 38 del 2009), introducendo nel codice penale il delitto di atti persecutori (art. 612-bis), ha al contempo modificato l’art. 576, comma 1, c.p., inserendo tra le aggravanti dell’omicidio doloso l’essere stato commesso dall’autore di atti persecutori nei confronti della stessa vittima. Occorre pure tener presente che tale modifica dell’art. 576 c.p. produce effetti anche sull’art. 585 c.p., che stabilisce che nei “casi previsti dagli articoli 582, 583, 583-bis, 583- quinquies e 584, la pena è aumentata da un terzo alla metà, se concorre alcuna delle circostanze aggravanti previste dall’articolo 576”. Con la sentenza in epigrafe le Sezioni Unite hanno affermato che l’omicidio aggravato dalla prece- dente commissione di atti persecutori costituisce un reato complesso, che però non ricorrerebbe nella parallela ipotesi di lesioni personali. L’Autore condivide in generale la sentenza ma non quest’ultima affermazione, ritenendo invece conseguenziale trattarsi anche qui di reato complesso. È vero che il legislatore, avendo lasciato inalterato il testo dell’aggravante dell’art. 585 c.p., prevede una pena paradossalmente più bassa di quella oggi stabilita dall’art. 612-bis c.p. per gli atti persecutori; ma è compito del legislatore o del giudice delle leggi risolvere tale evidente irragionevolezza normativa.
