Constitutional Judgment No. 63/2022 advances a multioffensive reading of the aggravating factors of the crime of facilitation of irregular immigration, which it uses to distinguish, in the regulation of Art. 12 TUI, between mere facilitation, punished in paragraph 1, which, according to the Court’s view, revolves around the «altruistic» conduct of an «individual» author, and smuggling of migrants, which the Court argues to be specifically criminalized instead in paragraphs 3, 3-bis and 3-ter, and to be evoking «scenarios of involvement of criminal organizations». This paper raises some criticisms of this reading, showing how it, in addition to not being necessary for the purpose of showing the unconstitutionality of the two aggravating factors under censure (use of international transportation services and use of counterfeit documents), does not fit to explain the actual contents of Article 12 TUI.

La sentenza costituzionale n. 63/2022 propone una lettura plurioffensiva delle aggravanti del favoreggiamento dell’immigrazione irregolare, che usa per distinguere, nella disciplina dell’art. 12 TUI, tra mero favoreggiamento, previsto al comma 1, e che consisterebbe in una condotta «individuale» e «altruistica», e traffico di migranti, che sarebbe previsto invece ai commi 3, 3-bis e 3-ter e che evocherebbe «scenari di coinvolgimento di organizzazioni criminali». In questo contributo si muovono alcune critiche a questa lettura, mostrando come essa, oltre a non essere necessaria allo scopo di mostrare l’incostituzionalità delle due aggravanti oggetto di censura (uso di servizi di trasporto internazionale e uso di documenti contraffatti), non si adatti a spiegare i contenuti effettivi dell’art. 12 TUI.
