The chapter calls for reflection on the role that, in a context of mass damage, can in fact play in the institution of civil liability, its functions, and its limits. Starting from the relevant aspects of the pandemic phenomenon in the perspective of the right to civil liability and from the correct identification of the criteria governing the formulation of the judgment of liability, the investigation focuses on the issue of the injustice of damage, as a central hub for the affirmation of civil liability. That there is damage, indeed different types of damage, from Covid-19 is undoubted, not so certain and subject to analysis is, instead, whether these damages are indemnifiable within our legal system, that is to say whether they pass the scrutiny of injustice and are as such imputable to a responsible conduct. In this direction, the author suggests a reflection on the criterion of injustice from the right perspective of the balance between fundamental rights that prevents the Courts, called to their protection, to arrive at the complete denial of one in the name of the affirmation of the other, exhorting them to the incessant search for a reasonable point of equilibrium, which severs upstream any attempt at tyranny. And perhaps the author believes the value of solidarity would induce us to look elsewhere, towards indemnity models that go beyond the threshold of injustice, provide compensatory responses because of a supreme principle of solidarity protection of victims.

Il capitolo sollecita una riflessione sul ruolo che, nell’ambito di un contesto di danni di massa, può di fatto rivestire l’istituto della responsabilità civile, le sue funzioni, e i suoi limiti. Muovendo dagli aspetti rilevanti del fenomeno pandemico nella prospettiva del diritto della responsabilità civile e dalla corretta individuazione dei criteri che presiedono alla formulazione del giudizio di responsabilità, l’indagine si concentra sul tema dell’ingiustizia del danno, quale snodo centrale per l’affermazione di una responsabilità civile. Che vi sia un danno, anzi diverse tipologie di danno, da Covid-19 è indubbio, non altrettanto certo e oggetto di analisi è, invece, se questi danni siano risarcibili all’interno del nostro ordinamento, vale a dire se superino il vaglio dell’ingiustizia e siano come tali imputabili a una condotta resa responsabile. In questa direzione l’autore suggerisce una riflessione sul criterio dell’ingiustizia dalla giusta prospettiva del bilanciamento tra diritti fondamentali che impedisce alle Corti, chiamate alla loro tutela, di giungere al completo disconoscimento dell’uno in nome dell’affermazione dell’altro, esortandole alla ricerca incessante di un ragionevole punto di equilibrio, che recida a monte ogni tentativo di tirannia. E forse ritiene l’autore il valore della solidarietà indurrebbe a rivolgere lo sguardo altrove, verso modelli indennitari che baipassando la soglia dell’ingiustizia, prevedano risposte compensative in ragione di un principio supremo di tutela solidale delle vittime.
