The "Infrastructure Decree" (converted into law in November 2021) has amended the art. 5 of the law n. 84/1994, by the provision of simplification mechanisms whose purpose is to ensure extreme promptness to the infrastructural decisions concerning the national port systems. This reform of the regulatory framework leads to a deep rethinking of the sea ports law’s previous objectives: the internal coherence of the port schemes, the harmonious connection between such schemes and urban planning, the synergy between port systems’ planning and the National Transports Plan. The article describes these changes highlighting their difficult coordination with the regulatory reforms launched in 2016 and their dubious compatibility with the constitutional framework.

Il “Decreto Infrastrutture”, convertito in legge nel novembre 2021, ha modificato la disciplina dettata dall’art. 5 della legge n. 84/1994, introducendo meccanismi di semplificazione delle procedure di pianificazione portuale il cui scopo è garantire massima celerità alle decisioni concernenti l’infrastrutturazione dei sistemi portuali nazionali. Questa riforma del quadro normativo si traduce in un profondo ripensamento degli obiettivi originari della legislazione in materia: la coerenza interna della pianificazione portuale, il raccordo armonico tra quest’ultima e la pianificazione urbanistica, la ricerca di una sinergia tra la pianificazione dei sistemi portuali e la pianificazione dei trasporti nazionali. L’articolo illustra queste trasformazioni, evidenziandone il difficile coordinamento con le riforme normative avviate a far data dal 2016 e la dubbia compatibilità con il quadro costituzionale.

Abstract
