With judgements no. 30490/2021 and no. 40652/2021 the Supreme Court affirmed that if the employee, as part of a contract, claims that the relationship is attributed to another employer, there is no burden of appeal from the cessation of the activity, unless there is a written communication equivalent to a dismissal. The regulations regarding limitation are, in fact, strictly interpreted and are not susceptible of analogous application. The Author examines the two decisions in the light of the overall context of the rules on limitation through an analysis of the jurisprudence of legitimacy and merit, even if not in conformity, to finally clarify that the position taken by the Supreme Court is correct.
