This purpose of this paper is to give some thought on the importance of environmental protection for the individual. It starts with the premise that all citizens should have the right to take legal action and obtain compensation for any environmental damage which could negatively affect an individual’s existential condition. Consequently, this lack of environmental protection is of the most discussed issues in Italy today. Furthermore, although EU legislation has provided for public protection against any environmental damage, it does not protect that of the individual.
