Moving from the examination of the order of the Court of Naples, July 13, 2020, the author re-examines the delicate issues of the relationship between the two oppositions ex art. 615 c.p.c. and related suspension measures. It therefore addresses the matter of the necessary persistence of inertia in the event of executive action by subrogation ex art. 2900 of the Italian Civil Code.
Muovendo dall’esame dell’ordinanza del Tribunale di Napoli 13 luglio 2020, l’autore riesamina i delicati temi del rapporto tra le due opposizioni ex art. 615 c.p.c. e dei relativi provvedimenti di sospensione. Affronta, quindi, il nodo della necessaria persistenza dell’inerzia in caso di esercizio dell’azione esecutiva in via surrogatoria ex art. 2900 c.c.
