Starting from the analysis of the most recent ECtHR and Italian Constitutional Court case law on strict prison regime (art. 4 bis, law n. 354/1975), the paper aims at providing a critical reading of the positions that suggest the abolition, or in any case a strong reshaping, of the so-called "ergastolo ostativo" (life sentence without parole). Based on the assumption that a variety of functions can be attributed to the criminal sanction, the proposed reflection intends to justify the legitimacy of a perspective which, while vindicating the need to temper the rigor of the current regime in order to ensure full compliance with the resocialising purpose of the criminal sanction, concurrently recognizes to this particular form of detention, when it is referred to the crimes of mafia type associ- ations and organized crime, a crucial role in the context of the overall interventions implemented by the criminal law maker to contrast the mafia.
A partire dall’analisi dei più recenti approdi giurisprudenziali della Corte EDU e della Corte costituzionale in materia in regime ostativo penitenziario (art. 4 bis ord. penit.), il contributo si propone di fornire una lettura critica delle posizioni che con varietà di accenti suggeriscono l’abolizione o comunque un forte ridimensionamento della figura dell’ergastolo c.d. “ostativo”. Muovendo dall’idea che alla sanzione penale sia ascrivibile una varietà di funzioni, la riflessione proposta intende motivare la legittimità di una prospettiva che pur rivendicando la necessità di temperare il rigore del regime ostativo vigente al fine di garantirne una piena conformità con il finalismo risocializzante della pena, tuttavia, riconosce a tale particolare forma di detenzione, quando riferita ai reati di associazione di stampo mafioso e di criminalità organizzata, un ruolo cruciale nel contesto degli interventi complessivamente messi in campo dal legislatore penale per il contrasto alle mafie.
