Il danno da perdita del rapporto parentale negli ordinamenti stranieri e la sua compatibilità con il principio dell'ordine pubblico: raffronti comparatistici alla luce della sentenza del Tribunale di Palermo n.2993/2020

The essay deals with the damage caused by loss of parental relationship and how it is regulated in various foreign legal systems. In particular, it will analyze the evolution of the Italian concept of the limit of “ordine pubblico”, as regulated by L. 218/1995, through a jurisprudence analysis and it will be highlighted that there is a hard core of this concept, which is linked to the protection of fundamental human rights, which cannot be affected by any foreign legal system. Finally, it will be seen how also the regulation of damages caused by the loss of parental relationship, being related to the protection of fundamental human rights, is intimately connected with the concept of “ordine pubblico".
