The essay focuses on the recent case on the condition of migrants' minor children in the hypothesis of repatriation orders issued against one of their parents. In particular, the Author analysis the hard balancing of contrasting values, which Court have to provide for, between public order and the rights to family unity (collective) and best interest of the child (individual).
