The paper aims to review the prevailing opinion according to which the sanctions of the indefensio in the classical noxal actions for the delicta servorum were the ductio or the missio in bona. For the author this opinion has no foundation in the texts while he thinks that the sanction in this matter was an action sine noxae deditione.
