The present work analyses the evolution of the multilevel jurisprudence on the contract of employment of former foreign language readers, currently foreign language collaborators: after describing the evolution of the legal framework, inconsistent and fragmented, the A. highlights that the jurisprudence has frequently contained the legislative discriminations against foreign language readers on the grounds of the principles of equal treatment and freedom of movement. In its final part the essay deals with the most recent jurisprudence of the Court of Cassation, that throughout an extensive interpretation has equalised the wages of former readers stabilized by court order with those of their colleagues hired on a permanent basis thanks to open competitions.
L’articolo analizza l’evoluzione della giurisprudenza multilivello sul rapporto di lavoro degli ex lettori di lingua straniera, oggi collaboratori linguistici: dopo una ricostruzione diacronica della legislazione di riferimento, l’A. sottolinea come la giurisprudenza – alla luce dei principi di libera circolazione e parità di trattamento – abbia arginato le discriminazioni di cui sono stati ripetutamente vittime gli ex lettori in ragione di un quadro normativo frammentario e disorganico. Infine, il saggio si sofferma sul più recente indirizzo di legittimità, che sulla base di un’interpretazione estensiva del dettato normativo ha equiparato il trattamento retributivo dei lettori stabilizzati per via giudiziaria a quelli assunti a tempo indeterminato tramite procedure selettive.
