Referring to the case of Beuze v. Belgium, the judges in Strasbourg appear to be distancing themselves from the Salduz doctrine, whilst recognising the violation of Ar ticle 6, §§ 1 and 3 c) of ECHR. Thus they appear to diminish the interpretation of the EU 2013/48 Directive and other legal sources from the European Union concerning the right of defence.
Nel caso Beuze c. Belgio i giudici di Strasburgo, pur riconoscendo la violazione dell’art. 6 §§ 1 e 3 lett. c) CEDU, sembrano allontanarsi dalla dottrina Salduz e sembrano volere sminuire il significato interpretativo della Direttiva 2013/48/UE e delle fonti dell’Unione europea sulle garanzie difensive.
