The Italian Antitrust Authority has launched an offensive against radiotaxi cooperatives that adopt rules and behaviors aimed at deterring their members from adhering to the new digital call sorting platforms. The IAA thus condemned the vertical agreements between taxi drivers’ cooperatives in the markets of Rome and Milan and initiated proceedings for abuse of a dominant position and cartelization in other territorial contexts. annulled the decisions on vertical agreements. The paper takes cue from the aforementioned proceedings, in order to make observations on the conflict between the cooperatives and Mytaxi and on the protection of competition between platforms and that between taxi drivers, in the light of antitrust law as well as of the regulation of cooperatives and that providing in the field of local public transport of people by taxi.
L’Autorità garante della concorrenza e del mercato ha avviato un’offensiva nei confronti delle cooperative di radiotaxi che adottano regole e comportamenti volti a dissuadere i propri soci dall’aderire alle nuove piattaforme digitali di smistamento delle chiamate. Ha così condannato le intese verticali tra cooperative di tassisti nei mercati di Roma e Milano e avviato procedimenti per abuso di posizione dominante e intese orizzontali in altri contesti territoriali. Lo scritto prende spunto dai procedimenti in questione, per svolgere osservazioni sul conflitto tra cooperative e Mytaxi e sulla tutela della concorrenza tra piattaforme e di quella tra tassisti, alla luce del diritto antitrust, della disciplina delle cooperative e di quella in materia di trasporto pubblico locale di persone mediante taxi.
