Sulla tutela del convivente ex art. 230-ter c.c.

The essay examines the rights that the art. 230-ter c.c. assigned to unmarried partner, which devotes permanently his work in the company of the other cohabitant. It aims to identify reason why the legislator recognizes only to the cohabitant of fact part of the rights that the art. 230-bis c.c. confer to the consort. The art. 1, co. 13, l. n. 76/2016 also introduces the same rights to the part of the civil union.

Il lavoro prende in esame i diritti che l’art. 230-ter c.c. assegna al convivente di fatto, «che presti stabilmente la propria opera all’interno dell’impresa dell’altro convivente», e si propone di individuare la ragione per la quale al primo è riconosciuta dal legislatore soltanto parte dei diritti che l’art. 230-bis c.c. attribuisce al coniuge e dei quali beneficia anche, ai sensi dell’art. 1, co. 13, l. n. 76/2016, la parte dell’unione civile.
