IL PRINCIPIO DEL DIVIETO DI PRONUNCIA CON RIFERIMENTO A POTERI AMMINISTRATIVI NON ANCORA ESERCITATI

The paper focuses on the principle, recently sanctioned in the code of the administrative trial, that prevents the administrative judge from ruling on administrative powers not yet exercised. The issue is dealt with both in the context of contentieux administratif tradition, also in the light of other principles, such as the separation of powers and the prohibition for the judge to take the place of the public administration, and with regard to jurisprudential applications.

Lo scritto verte sul principio che impedisce al giudice amministrativo di pronunciarsi su poteri amministrativi non ancora esercitati, di recente sanzionato nel codice del processo amministrativo. Il tema è trattato sia nel contesto della tradizione del contenzioso amministrativo, anche alla luce di altri principi, come quello della separazione dei poteri e del divieto di farsi amministratore, sia con riguardo alle applicazioni giurisprudenziali.
