The paper tackles the issue of human trafficking, from a multi-level perspective.First, it considers both the human-rights-oriented approach to the matter and the importance of a law enforcement action. In the face of their diversity, the necessity will be underlined of integrating these two approaches. As an example of this holistic perspective, the UN Protocol against Trafficking in Persons sets forth a comprehensive approach, based on repressive penal measures, but also on preven- tion, cooperation between states and protection and assistance for the victims. According to the current interpretation, the difference with migrant smuggling, which is the object of a different protocol to the UN Convention on Transnational Organized Crime and aims to control migration flows, revolves around the involved persons, as victims or not of these two crimes. Such a rigid separation is also reaffirmed both in European norms and in Italian law on the matter. However, the boundary between these two phenomena is frequently blurred, as various kinds of relationships may exist between them. Italian judges, however, have frequently applied this distinction too strictly, whereas the osmotic relationship between these two criminal conducts should not be overlooked so as to ensure a more adequate protection of human dignity.

Il contributo affronta il tema della tratta di esseri umani in una prospettiva di contrasto multilivello, che mette in rilievo la dignità della persona, quale meta-valore ordinamentale, e la considerazione delle esigenze di contrasto alle nuove forme di criminalità. A tal proposito, si evidenza la necessità di una considerazione integrata delle due prospettive, ormai recepita nell’approccio olistico di contrasto al fenomeno affermatosi a livello sovranazionale. A fianco della tradizionale repressione penale, il Protocollo Trafficking in Persons alla Convenzione ONU di Palermo sul crimine organizzato transnazionale inserisce rilevanti norme sulla prevenzione, la cooperazione tra Stati e la protezione e l’assistenza delle vittime. Su quest’ultimo aspetto si appunterebbe la distinzione con il c.d. smuggling of persons che, oggetto di distinto Protocollo allegato alla Convenzione di Palermo, è volto, invece, al controllo dei flussi migratori. L’approccio di rigida separazione fra le due modalità di condotta è poi ribadito anche negli strumenti adottati a livello europeo. Anche la normativa italiana, a sua volta, rispecchia la distinzione: la condotta illecita della tratta è incentrata sullo sfruttamento finale del migrante ed è posta a tutela della personalità individuale (art. 601 c.p.), mentre il traffico di migranti rileva come favoreggiamento dell’immigrazione illegale ed è regolato extra codicem all’art. 12 TUIMM. Tuttavia il confine fra i due fenomeni è spesso labile e vanno considerate le relazioni che possono sussistere reciprocamente. La giurisprudenza italiana ha però talvolta adottato la distinzione in esame in modo troppo rigido, laddove invece una corretta considerazione del carattere osmotico delle due attività illecite gioverebbe ad una più attenta tutela della dignità umana.
