The effort of the paper is to examine how the South African Constitutional Court, in the CCT 23/96 Certification of the Constitution of the Republic of South Africa, 1996, has considered foreign law and if it has conducted a study of comparison, with a particular attention on the subject of fundamental rights. The study analyses the degree of comparison, its formative nature and finally it establishes which rule of foreign law has been considered (legislative, dottrinal or case-law). Therefore the research verifies whether there is a preference on a particular giuridical system and why.

Obiettivo di questo studio è di esaminare, nel giudizio di conformità operato dalla Corte costituzionale sudafricana nel caso CCT 23/96 Certification of the Constitution of the Republic of South Africa, 1996, a conclusione del processo costituente sudafricano, i richiami comparatistici operati dalla Corte, per verificare il ruolo esercitato dal diritto straniero, in particolare nell’ambito delle previsioni inerenti i diritti fondamentali. L’analisi si sofferma quindi sulla natura dei riferimenti comparatistici, se generali o specifici, sul tipo di formante richiamato (normativo, giurisprudenziale o dottrinale), sull’importanza da dare al richiamo del diritto straniero e sull’uso costruttivo o meno che di esso si sia fatto. La ricerca, inoltre, si prefigge lo scopo di verificare se sussiste la preferenza verso un determinato sistema giuridico, cercando di individuarne le ragioni.
