NELLA “REVISIONE INFINITA” DEL PROCESSO CONTRADA I NODI IRRISOLTI DELL’ESECUZIONE DELLE SENTENZE CEDU E DEL CONCORSO ESTERNO NEL REATO ASSOCIATIVO

The rejection of the request for revision of the Contrada trial once again focuses attention on the issues of legal certainty/foreseeability of “external participation in criminal association” cases and the execution of judgements by the ECHR. Retracing the debate in the field we find supposed appropriate strategies for achieving the “highest level of rights protection” as part of the “changeable” Res Judicata.

Il rigetto della richiesta di revisione del processo Contrada pone ancora una volta all’attenzione i te1mi della tassavità – prevedibilità della fattispecie di concorso esterno nell’associazione mafiosa e dell’esecuzione delle sentenze CEDU. Ripercorrendo il dibattito in materia, si ipotizzano strategie idonee a realizzare il “massimo livello di tutela dei diritti” nell’ambito della res iudicata “mutevole”.
