 Una riflessione sul giusnaturalismo. A proposito delle teorie di J. Finnis e R.P. George

According to the classic theory of Bobbio and Nino, natural law theories hold two main theses. The fir st has a conceptual nature and is centered around the concep t of law and the necessary relation between law and morality. The second is a metaethical thesis about the objectivity of moral values. As Viola argues, a fter the revolution in theory offered by Finnis, today’s nat ural law theory presents itself as an ethical theor y based on a normative concept of nature and of reasonable justi ce, rather than as a theory of morality. The curren t contrast between legal positivists and natural law theorists seems mainly ideological and partly ontological.

ABSTRACT Secondo la teoria classica di Bobbio e di Nino, due sono le tesi fondamentali del giusnaturalismo. Una tesi sul concetto di diritto, e sulla connessione necessaria , di carattere definitorio, tra diritto e morale. E una tesi metaetica di tipo oggettivista. Oggi, come sostiene Viola, dopo la rivoluzione di Finnis, il giusnatur alismo si presenta non più come una teoria della morale, ma c ome un’etica derivata dal carattere normativo della natura e da un uso specifico della ragionevolezza pratica. I n particolare ideologica, e in parte ontologica, se mbra oggi la contrapposizione tra giuspositivisti e giusnaturali sti.
