Per la datazione del palinsesto veronese delle Institutiones di Gaio (Verona, B. Cap., Cod. XV)

This paper addresses the question of the dating of the palimpsest of Gaius' Institutes (Verona, B. Cap., Cod. XV). A comparison with other manuscripts written for certain in the 6th century in "B-R" uncial shows that this kind of script was characteristic of the Byzantine area in Justinian's age. The possible objection against its dating to the Justinianic period is reconsidered in the light of the fact that the abbreviations in legal texts of Justinian's compilation were officially banned only at the end of 533 AD and that such a prohibitions was in force in the western part of the Roman empire some years later. The conclusion is that Gaius' manuscript was most likely written in the Justinianic period.

In questo contributo è esaminata la questione della datazione del palinsesto delle Institutiones di Gaio (Verona, B. Cap., Cod. XV). Un confronto con altri manoscritti sicuramente realizzati nel VI secolo in onciale B-R mostra che questo genere di scrittura era peculiare dell'area bizantina in età giustinianea. La possibile obiezione contro una sua datazione all'età di Giustiniano è riconsiderata alla luce del fatto che le abbreviature nei testi giuridici della compilazione di Giustiniano furono ufficialmente vietate da questo imperatore solamente alla fine del 533 d.C. e che tale divieto entrò in vigore nella parte occidentale dell'impero romano solamente alcuni anni dopo. La conclusione più probabile, pertanto, è che il manoscritto gaiano sia stato esemplato in età giustinianea.
