Mediation is one of the more innovative ways in which the community has tried to face the conflict due to the increase of complexity of social ties and to the amplification of the differences between interests, values and objectives of the different actors of everyday life. In the context of family specificity of mediation is to be an intervention aiming at the reorganization of the relations and the resolution or mitigation of conflicts in case of separation or divorce. It is offered as a "place" for the management and reworking of the problems caused just by the actual difficulty of defining figures and family roles both in the way in which the family organizes its internal life(rules, affection, child custody, testimony and transmission of value orientations and lifestyles, family memory); and in the way it rules the borders with the outside world, with the social context (work, life times, external commitments of children). In Sicily, family mediation has found one of the first areas of development, confirming the sensitivity cultivated over time by psychologists and lawyers, but mainly by social workers who knew how to work in interdisciplinary teams. The experiences of mediation are interwoven with the analysis on the relationship between mediation, services and civil society, as well as the contribution that lawyers, judges and service operators are able to offer in the management of conflicts in mixed marriages and in shared foster care, without neglecting the reflection on obstacles, potentialities and lines of development desired for mediation within the family services.
La mediazione è una delle forme più innovative con cui la collettività ha cercato di affrontare la conflittualità legata all’aumento di complessità dei legami sociali e all’amplificazione delle differenze tra interessi, valori e obiettivi dei diversi attori della vita quotidiana. In ambito familiare lo specifico della mediazione è quello di essere un intervento volto alla riorganizzazione delle relazioni e alla risoluzione o attenuazione dei conflitti in caso di separazione o di divorzio. Essa si offre come “luogo” di gestione e di rielaborazione dei problemi generati proprio dalla difficoltà odierna di definire le figure e i ruoli familiari sia nelle modalità in cui la famiglia organizza la propria vita interna (regole, affetti, custodia dei figli, testimonianza e trasmissione degli orientamenti valoriali e degli stili di vita, memoria familiare); sia nel modo in cui regola i confini con l’esterno, con il contesto sociale (lavoro, tempi di vita, impegni esterni dei figli). In Sicilia la mediazione familiare ha trovato uno dei primi territori di sviluppo, a conferma di una sensibilità coltivata nel tempo da psicologi e avvocati, ma soprattutto da assistenti sociali che hanno saputo operare in gruppi interdisciplinari. Le esperienze di mediazione vengono intrecciate all’analisi intorno al rapporto tra Mediazione, servizi e società civile, come pure al contributo che avvocati, magistrati e operatori dei servizi sono in grado di offrire nella gestione dei conflitti nei matrimoni misti e nell’affido condiviso, senza trascurare la riflessione su ostacoli, potenzialità e linee di sviluppo auspicate per la mediazione all’interno dei servizi per la famiglia.
