This volume addresses, in a comprehensive and unified manner, a constantly evolving subject. Restricting ourselves here to only the regulatory changes that have affected the Criminal Code, we must first consider Legislative Decree No. 21 of March 1, 2018, containing "Provisions for the implementation of the principle of delegation of the reserve of the code in criminal matters pursuant to Article 1, paragraph 85, letter q), of Law No. 103 of June 23, 2017" (the so-called Orlando Law). This legislative decree, not only inserted Article 240-bis, which is now the last article of the general part and provides for a possibility of mandatory confiscation, among others, for the crimes referred to in Articles 600-bis, paragraph 1, 600-ter, paragraphs 1 and 2, 600-quater.1, regarding the production or trade of pornographic material, 600-quinquies. However, art. 602-ter has been amended and two paragraphs have been added to art. 601 (which incorporates the repealed articles 1152 and 1153 of the Navigation Code). The main intervention on this matter, however, is Law No. 69 of July 19, 2019, containing "Amendments to the Criminal Code, the Code of Criminal Procedure, and other provisions regarding the protection of victims of domestic and gender-based violence" (the so-called Red Code). This law introduced the following articles: 387-bis (violation of orders for expulsion from the family home and the prohibition on approaching places frequented by the victim); 558-bis (coercion or inducement to marry); 612-ter (illegal dissemination of sexually explicit images or videos, so-called revenge porn); 583-quinquies (deformation of a person's appearance through permanent facial injury). Furthermore, the law amended Articles 61, number 11-quinquies, 165, 572, 576, 577, 583, 585, 609-bis, 609-ter, 609-quater, 609-septies, 609-octies, and 612-bis. Finally, further aspects explored in the text were also addressed by Law No. 238 of December 23, 2021, containing "Provisions for the fulfillment of the obligations arising from Italy's membership of the European Union - European Law 2019-2020." Specifically, this law amended Articles 600-quater, 602-ter, 609-ter, 609-quater, 609-quinquies, and 609-undecies. The work, which combines the ease of a manual with the form of a commentary, also studies the procedural profiles and the various non-criminal measures introduced, paying particular attention to the doctrinal development and the jurisprudential applications introduced to date.

Il volume affronta, in modo organico ed unitario, una materia in perenne evoluzione. Limitandoci qui a richiamare le sole modifiche normative che hanno interessato il codice penale, occorre innanzitutto considerare il d.lg. 1.3.2018, n. 21, recante «Disposizioni di attuazione del principio di delega della riserva di codice nella materia penale a norma dell’articolo 1, comma 85, lettera q), della legge 23 giugno 2017, n. 103» (c.d. legge Orlando). Con tale decreto legislativo, non solo è stato inserito l’art. 240-bis, che è ora l’ultimo articolo della parte generale e che prevede una ipotesi di confisca obbligatoria, tra gli altri, per i delitti di cui agli artt. 600-bis, comma 1, 600-ter, commi 1 e 2, 600-quater.1, relativamente alla condotta di produzione o commercio di materiale pornografico, 600-quinquies. Ma è stato modificato l’art. 602-ter e sono stati aggiunti due commi all’art. 601 (che incorpora gli abrogati artt. 1152 e 1153 del codice della navigazione). Sulla materia è però soprattutto intervenuta la l. 19.7.2019, n. 69, recante «Modifiche al codice penale, al codice di procedura penale e altre disposizioni in materia di tutela delle vittime di violenza domestica e di genere» (c.d. codice rosso). Detta legge ha introdotto gli artt.: 387-bis (violazione dei provvedimenti di allontanamento dalla casa familiare e del divieto di avvicinamento ai luoghi frequentati dalla persona offesa); 558-bis (costrizione o induzione al matrimonio); 612-ter (diffusione illecita di immagini o video sessualmente espliciti, c.d. revenge porn); 583-quinquies (deformazione dell’aspetto della persona mediante lesioni permanenti al viso). Ancora, la legge ha modificato gli artt. 61, numero 11-quinquies, 165, 572, 576, 577, 583, 585, 609-bis, 609-ter, 609-quater, 609-septies, 609-octies, 612-bis. Infine, su ulteriori profili approfonditi nel testo ha inciso anche la l. 23.12.2021, n. 238, recante «Disposizioni per l’adempimento degli obblighi derivanti dall’appartenenza dell’Italia all’Unione europea - Legge europea 2019-2020». In particolare, tale legge ha modificato gli artt. 600-quater, 602-ter, 609-ter, 609-quater, 609-quinquies, 609-undecies. L’opera, che unisce alla scorrevolezza del manuale le forme del commentario, studia anche i profili processuali e le diverse misure extrapenalistiche introdotte, ponendo particolare attenzione all’elaborazione dottrinale ed alle applicazioni giurisprudenziali sin qui intervenute.
