This collection of state and regional laws and the commentary that accompanies them is intended to offer an overview of the rules that apply in the Sicilian regional legislation on the matter of contracts (for works, supplies and services) and concessions after entry into force (and effective date) of the Public Contracts Code (Legislative Decree 31 March 2023, no. 36) and the publication of the Regional Law. 12 October 2023, n. 12. This legislation has adapted the regional system to state legislation deriving from the transposition of European public procurement law, in the wake of similar precedents regulatory interventions on the matter (regional laws no. 10/1993, no. 7/2002, no. 7/2003, no. 12/2011, n. 9/2015, n. 8/2016 and n. 1/2017). The law with which the Sicilian Region exercised legislative powers in the matter – exclusive for works and internal organisation, competitor for supplies and services – in application of the safeguard clause provided for by the delegated law of 21 June 2022, n. 78 (art. 2), has, in turn, "implemented" through so-called "dynamic postponement" of the provisions of the Code, grafting them, however, rather than in a new legislative text, in the fabric of the regional law. n. 12/2011 and subsequent amendments, to which they come additions and modifications and certain insertions were also made. The complex work of adaptation, it is worth underlining, in the singular context of a "second transposition" carried out by the state legislator of the Union public procurement law, concerns only the parts of the Code that affect regional competences. In fact, they find direct application the code provisions attributable to the matters falling within exclusive jurisdiction state (think of those relating to the principles, the central organization: Ministry, Superior Council of public works, ANAC, or that concerning jurisdictional protection and alternative remedies). The result is a new composite and, in some ways, fragmentary regulatory framework in which the following coexist: parts of the regional legislation transposing the first Public Contracts Code of 2006, the aforementioned l.r. n. 12/2011 and subsequent amendments, the Public Contracts Code of 2023, verbatim "implemented" by the regional law 12 October 2023, n. 12, including its mandatory parts in relation to the regime of exclusive state competences, the regional rules introduced ex novo by the latter (think to the opinion and price list regime, to the Single Central Procurement Center for regional public contracts, to the Regional Commission for Public Works), and other pre-existing regional provisions, but interacting with the specific regulation of public works, services, supplies and concessions. Furthermore, it is a context "in progress", not only due to its own structural dynamism of the 2023 Code in the relationship between the rules included in it, the annexes and the regulatory provisions of delegation which is expected to be issued and replaced by those attached, but which is also reconnected with the implementation obligations contemplated by regional law (regulations and decrees), in order to constitute a regulatory framework that progressively finds and will find completion. A summary has been included as a summary of the regional legislation on the subject collection of provisions on the organization, specifically referring to that of infrastructures and its central and peripheral structures, and on the activity of the regional administration in order to better to contextualize the reform of public contracts in the regional system and offer references essential for legal practitioners and public contract technicians.).

Questa raccolta di leggi statali e regionali ed il commento che le accompagna intendono offrire un panorama delle norme che trovano applicazione nell’ordinamento regionale siciliano in materia di appalti (di lavori, forniture e servizi) e concessioni dopo l’entrata in vigore (e l’intervenuta efficacia) del Codice dei contratti pubblici (d.lgs. 31 marzo 2023, n. 36) e la pubblicazione della l.r.12 ottobre 2023, n. 12. Tale normativa ha adeguato l’ordinamento regionale alla normativa statale derivante dal recepimento del diritto europeo degli appalti pubblici, nel solco di analoghi precedenti interventi normativi in materia (leggi regionali n. 10/1993, n. 7/2002, n. 7/2003, n. 12/2011, n. 9/2015, n. 8/2016 e n. 1/2017). La legge con la quale la Regione Siciliana ha esercitato le competenze legislative in materia – esclusiva per i lavori e l’organizzazione interna, concorrente per forniture e servizi –, in applicazione della clausola di salvaguardia prevista dalla legge-delega 21 giugno 2022, n. 78 (art. 2), ha, a sua volta, “recepito” mediante c.d. “rinvio dinamico” le norme del Codice innestandole, tuttavia, piuttosto che in nuovo testo legislativo, nel tessuto della l.r. n. 12/2011 e ss.mm.ii., alla quale vengono apportate, altresì, integrazioni e modificazioni e talune inserzioni. La complessa opera di adeguamento, giova sottolinearlo, nel singolare contesto di un “secondo recepimento” operato dal legislatore statale del diritto unionale degli appalti pubblici, riguarda soltanto le parti del Codice che inferiscono sulle competenze regionali. Trovano, infatti, diretta applicazione le disposizioni codicistiche riconducibili alle materie rientranti nella competenza esclusiva statale (si pensi a quelle relative ai principi, all’organizzazione centrale: Ministero, Consiglio superiore dei lavori pubblici, ANAC, o quella concernente la tutela giurisdizionale ed i rimedi alternativi). Ne risulta un nuovo quadro normativo composito e, per certi versi, frammentario nel quale convivono: parti della normativa regionale di recepimento del primo Codice dei contratti pubblici del 2006, la ricordata l.r. n. 12/2011 e ss.mm.ii., il Codice dei contratti pubblici del 2023, testualmente “recepito” dalla l.r. 12 ottobre 2023, n. 12, comprese le sue parti inderogabili in relazione al regime delle competenze esclusive statali, le norme regionali introdotte ex novo da quest’ultima (si pensi al regime dei pareri e del prezzario, alla Centrale unica di committenza dei contratti pubblici regionale, alla Commissione regionale per i lavori pubblici), ed altre disposizioni regionali preesistenti, ma interagenti con la specifica disciplina di lavori pubblici, servizi, forniture e concessioni. Si tratta, peraltro, di un contesto “in divenire”, non solo per il dinamismo strutturale proprio del Codice del 2023 nel rapporto tra norme inserite nello stesso, gli allegati e le disposizioni regolamentari di delegificazione delle quali si prevede l’emanazione ed il subentro a quelle allegate, ma che si riconnette, altresì, con gli adempimenti di esecuzione contemplati dalla legge regionale (regolamenti e decreti), in guisa da costituire un ordito normativo che progressivamente trova e troverà completamento. A compendio della normativa regionale in materia è stata inserita una sintetica raccolta di disposizioni sull’organizzazione, specificamente riferita a quella delle infrastrutture e delle sue strutture centrali e periferiche, e sull’attività dell’amministrazione regionale al fine di meglio contestualizzare la riforma dei contratti pubblici nell’ordinamento regionale ed offrire riferimenti essenziali per operatori del diritto e tecnici dei contratti pubblici.
