Through the combination of criminological and legal-normative research, and thanks also to the collaboration with external experts (scholars, magistrates, representatives of Italian and foreign institutions), the research investigated the interactions between different trafficking and crime organized in the Mediterranean basin. In this historically crucial area for the mobility of persons and goods, attention has been paid in particular to the phenomena of trafficking and smuggling of persons, drug trafficking and of cigarette smuggling. The contributions collected - together with the criminological report and the five national reports accessible at www.unipa.it/nesmes.pmi and dedicated to the criminal systems under investigation (Italy, Germany, Spain, Portugal, Greece) - intend to provide an in-depth and varied view of the theme studied: socio-criminological analysis and reflection coexist in it. legal (this, in turn, is both substantive and procedural), the study of the Italian standards and their placement in a more broad (European, international, but also comparative), the point of view of the scholar and the magistrate. It emerges the idea that, among the three types of traffic considered, there may be pragmatic and structural relationships to which the states should devote more attention, with a view to more contrast fair and effective, as part of a balance between mobility and safety appropriate to the relevance of the Mediterranean area at European level, and international.
Attraverso la combinazione di ricerca criminologica e giuridico-normativa, e grazie anche alla collaborazione con esperti esterni (studiosi, magistrati, rappresentanti di istituzioni italiane e straniere), la ricerca da cui scaturisce il volume ha indagato le interazioni tra i diversi traffici illeciti e la criminalità organizzata nel bacino del Mediterraneo. In tale area, storicamente cruciale per la mobilità di persone e di beni, l’attenzione si è rivolta in particolare ai fenomeni del traffico e della tratta di persone, del traffico di stupefacenti e del contrabbando di sigarette. I contributi raccolti – unitamente al rapporto criminologico e ai cinque rapporti nazionali accessibili su www.unipa.it/nesmes.pmi e dedicati ai sistemi penali oggetto della ricerca (Italia, Germania, Spagna, Portogallo, Grecia) – intendono fornire una visione approfondita e variegata del tema studiato: vi convivono l’analisi socio-criminologica e la riflessione giuridica (questa, a sua volta, di diritto sia sostanziale sia processuale), lo studio delle norme italiane e la loro collocazione in un contesto più ampio (europeo, internazionale, ma anche comparatistico), il punto di vista dello studioso e quello del magistrato. Ne emerge l’idea che, fra i tre tipi di traffico considerati, possano darsi relazioni pragmatiche e strutturali cui gli stati dovrebbero dedicare maggiore attenzione, in vista di un contrasto più giusto ed efficace, nel quadro di un bilanciamento fra mobilità e sicurezza adeguato alla rilevanza dell’area del Mediterraneo a livello europeo ed internazionale.
