In spite of recent openings the European Court of Human Rights has always considered the Article 6, § 1, of the Convention not applicable to the tax proceedings, because tax matters still form part of the “hard core” of public-authority prerogatives. However, this exclusion is hardly compatible with the nature and structure of the right to a fair trial. If this right is a fundamental right (with the typical nature and structure of these rights), we need to ask whether the public-authority prerogatives can restrict its range, and this question is strictly connected with theoretical issue concerning the extension of the limits of the fundamental rights. In fact, if we could say that a fundamental right “withstands” the public-authority prerogatives, we also could say that the position kept by the Court is quite controversial. This article deepens the study behind this issiue.

La Corte Europea dei Diritti dell’Uomo, nonostante recenti aperture, ha sempre ritenuto inapplicabile l’art. 6, par. 1, della Convenzione al processo tributario e ciò in quanto la materia fiscale rappresenterebbe il cd. “nocciolo duro” delle prerogative delle potestà statuali. L’esclusione della garanzia, però, pone un problema di conciliabilità con la natura e la struttura del diritto ad un giusto processo. Se, infatti, questo diritto ha natura e struttura di diritto fondamentale, occorre domandarsi se effettivamente tale diritto sia comprimibile a fronte della potestà di imperio di uno Stato; il che conduce, inevitabilmente, alla questione teorica concernete i limiti di estensione dei diritti fondamentali. Qualora, infatti, dovesse ritenersi che tale tipologia di diritti “resiste” a fronte delle prerogative delle potestà di imperio di uno Stato dovrebbe concludersi che, almeno a livello teorico, la posizione mantenuta dalla Corte di Strasburgo mostra evidenti perplessità. A queste problematiche è informato lo studio contenuto nel presente scritto.
