La proprietà, i possessi, la detenzione.

It is insghtful to investigate the definitions used in the jurisprudence. comparing the definitions reported in the two Italian codxdes, the one of 1865 and the current one, valuable results emerge in the field of property and possession. In particular the most evident differences occur in the possession. While the first Italian code was not far from the ancient concepts contained in the Institutiones of Gaius and Justinian, in the current code the possession has acquired completely new characterristics and profiles.

Il saggio si sofferma sulle definizioni adoperate dalla scienza giuridica. Operando il confronto delle definizioni scritte nei due codici italiani, quello del 1865 e quello in vigore, emergono conclusioni preziose in ordine alla proprietà e al possesso. Mentre il primo codice unitario non si discostava dalle antiche definizioni contenute nelle Istituzioni di Gaio e di Giustiniano, il possesso ha assunto nella definizione del codice vigente, caratteristiche e profili del tutto nuovi.
