IL SERVIZIO DI DISTRIBUZIONE DEL GAS TRA REGOLAZIONE STATALE E REGIONALE DOPO LA SENTENZA DELLA CORTE COSTITUZIONALE N.16 DEL 2020

The work covers the complex regulatory evolution of the natural gas market that has required, after several postponements, municipal administrations to take, in a short time, decisions and measures with a strong impact on the future organization of the gas distribution service and the interests of citizenship. In particular, the judgment of the Constitutional Court no. 16 of 2020 is examined in detail, whereby it was held that, although the Sicilian Regional Administration is attributed, in accordance with the Statute of Autonomy, concurrent legislative competence in the field of public services of main regional interest, this power must, in any case, be exercised within the limits of the principles and general interests underlying the legislation of the State and, in the case in point, of the natural gas distribution service.

Lo studio tratta la complessa evoluzione normativa del mercato del gas naturale che ha imposto, dopo vari rinvii, alle amministrazioni comunali l’obbligo di assumere, in tempi brevi, decisioni e provvedimenti con forte impatto sulla futura organizzazione del servizio di distribuzione del gas e sugli interessi degli utenti. In particolare si approfondisce la disciplina statale, quella regionale siciliana, con riguardo alla sentenza della Corte Costituzionale n. 16 del 2020 con la quale si è ritenuto che sebbene alla Regione Siciliana sia attribuita, ai sensi dello Statuto di autonomia, la competenza legislativa concorrente in materia di servizi pubblici di prevalente interesse regionale, tale potestà deve in ogni caso essere esercitata entro i limiti dei princìpi ed interessi generali cui si informa la legislazione dello Stato e, nel caso di specie, del servizio di distribuzione del gas naturale.
