This chapter focuses on the many legal issues related to the rise of sharing mobility in Europe. In the first part, it outlines the most fundamental economic transformations that make the case for regulating sharing mobility services quite different from conventional transport. Along these lines, the purpose of the article is to identify those emerging legal issues stemming from the advent of the sharing, in order to categorise the competing claims that regulators should be considering when facing these innovative practices. On this regard, the article not only elaborates on the main concerns related to market regulation, but it also scrutinises those aspects of the sharing mobility that go beyond market and efficiency concerns, to consider those features that are more significant for fostering an inclusive and sustainable society. In its last part, it considers whether a new regulatory framework is desirable in the light of the ongoing changes.

L’articolo propone un’analisi delle principali questioni relative alla regolamentazione dei servizi di sharing (o shared) mobility. Attraverso una disamina dei tratti peculiari dei diversi modelli di organizzazione economica per l’offerta di servizi di mobilità condivisa, si ricostruiscono i principali nodi problematici connessi tanto alla definizione di regole di governo del mercato dei nuovi servizi di mobilità, quanto all’esigenza di garantire una mobilità che sia anche veicolo di inclusione sociale e di sostenibilità ambientale. Nel farlo, l’articolo offre una riflessione critica sulle opposte polarità che caratterizzano il dibattito corrente in tema di sharing mobility: per un verso, la spinta verso una revisione drastica delle regole esistenti attraverso una massiccia deregolamentazione del settore (deregulating down); per altro verso, l’assoggettamento dei servizi di sharing mobility, erogati tramite piattaforme informatiche, alla disciplina di settore (regulating up). Si mostra ome la contrapposizione tra le opposte ragioni di regolamentare e deregolamentare la sharing mobility sia esacerbata dal presente quadro normativo e ragiona sull’elaborazione di principi che consentano il superamento della polarizzazione del dibattito tra i fautori dell’una e dell’altra posizione, provando a definire, nell’ultima parte, i principi cardine che dovrebbero ispirare una politica comune europea per la sharing mobility.
