Il feudo siciliano nella coscienza giuridica tardo-settecentesca: concessioni, natura, forma

Starting from the juridical debate in the late 18th century, when feudal abuses were more contrasted than ever, the present essay aims to outline the characteristics of the Sicilian fief in the Early Modern Age: concessions, nature, form. The discussion was mainly developed regarding the interpretation of the chapters Si aliquem (1286) and Volentes (1296), but ultimately the issue at stake concerned the relationship between the sovereign authority and feudal jurisdiction. The different legal opinions haven’t found a definitive formulation and so the question is still open.

A partire dal dibattito giuridico che si sviluppò nel tardo Settecento, quando gli abusi feudali furono più che mai messi in discussione, il presente saggio intende delineare le caratteristiche del feudo siciliano in età moderna: concessioni, natura, forma. La discussione si sviluppò principalmente sull’interpretazione dei capitoli Si aliquem (1286) e Volentes (1296), ma in ultima analisi la posta in gioco riguardava il rapporto tra il potere sovrano e la giurisdizione feudale. Le differenti opinioni sul piano giuridico non trovarono però una definitiva formulazione e così la questione risulta ancora aperta.
